REGULATIONS FOR UNATTENDED PAID PARKING LOT

located at ul.
Merliniego 2 in Warsaw (hereinafter referred to as “Regulations”)

§ 1.

The parking lot located in Warsaw at ul.
Merliniego 2 (hereinafter referred to as “Parking Lot“), in front of the children’s amusement park called Fun Park Digiloo (hereinafter referred to as “Playroom“) is managed by the lessee of the area – the company DB&M INVESTMENTS Sp.
z o.o. with its registered office in Warsaw, entered in the National Court Register under the KRS number 0000413586 (hereinafter “Company” or “Manager“).

§ 2.

  1. Only cars and vans with a gross vehicle weight of up to 3.5 tons may enter the parking lot.
  2. Entry into the Parking Lot of cars other than those indicated in paragraph.
    1 of this paragraph requires the consent of the Manager.

§ 3.

  1. Upon entry into the Parking Lot, the person driving the vehicle enters into a parking space lease agreement (as the lessee) with the Company (as the lessor), under the terms and conditions specified in the Regulations and generally applicable laws, including in particular the provisions of the Act of April 23, 1964.
    Civil Code.
  2. Entering the parking area is tantamount to agreeing to the provisions of the Regulations.
  3. By entering the Parking Lot, the user of the vehicle undertakes to comply with the provisions of the Regulations.

§ 4.

  1. The parking lot is not guarded.
  2. Use of the Parking Lot by customers of the Playroom is free of charge.
  3. The use of the Parking Lot by persons other than customers of the Amusement Park is associated with the obligation to pay a fee of 150,- PLN for the first started hour of use of the Parking Lot and 50,- PLN for each subsequent started hour of use of the Parking Lot.
  4. The fees specified in the Regulations are gross fees.

§ 5.

  1. The Manager shall not be liable for any damage to vehicles located in the Parking Lot and shall not be responsible for items left in these vehicles by owners/users.
  2. The Manager shall not be liable for any damage caused to users of the Parking Lot by vehicle drivers, other persons in the Parking Lot or by third parties.
  3. The user of the vehicle using the Parking Lot is responsible for any damage caused to the Manager and third parties in the Parking Lot.
  4. Costs resulting from failure to comply with the rules set forth in the Regulations will be charged to the driver of the vehicle or other person who caused the costs.

§ 6.

  1. Parking is open only during the opening hours of the Playroom, as well as 15 minutes before the opening of the Playroom and 15 minutes after the closing of the Playroom on a given day.
  2. Use of the Parking Lot outside the hours specified in paragraph.
    1 of this paragraph requires each time the prior consent of the Manager.

§ 7.

  1. The provisions of the Act of June 20, 1997 shall apply to the Parking Lot.
    Traffic Law and other generally applicable provisions of law governing traffic on public roads, in residential zones and in traffic zones.
  2. The maximum speed of vehicles on the territory of the Parking Lot is 10 kilometers per hour.
  3. The user is obliged to observe vertical and horizontal road signs and numerical markings of parking spaces in the Parking Lot.
  4. When performing parking maneuvers, the driver of the vehicle is required to exercise extreme caution, and perform all maneuvers so as not to damage other vehicles in the Parking Lot.
  5. Leave the vehicle immobilized, with the ignition off and no lights on.
  6. Control over the correctness of vehicle parking is the responsibility of the Manager’s employees.
  7. If the user fails to comply with the rules of the Parking Lot, the Manager is entitled to remove the vehicle under the rules described in § 9 of the Regulations.

§ 8.

In the Parking Lot it is prohibited to:

  1. Smoking tobacco products and the use of open flames outside of designated areas;
  2. Consumption of alcoholic beverages and use of intoxicants;
  3. Polluting the Parking Lot, in particular leaving garbage and waste;
  4. Violating public order, especially by making noise or playing loud music;
  5. Washing and vacuuming the vehicle, repairing, replacing coolants, fuel or oil in the vehicle;
  6. Unjustifiably leaving the vehicle with the engine running (on);
  7. Unjustified performance of vehicle maintenance and repair activities or fueling;
  8. Leaving children and animals unattended in the vehicle;
  9. Moving around on bicycles, roller blades or skateboards;
  10. Conducting business, including advertising goods or services;
  11. Towing of vehicles, unless justified by a material need;
  12. Movement of vehicles with trailers, articulated vehicles and special vehicles,
  13. Moving vehicles carrying flammable, corrosive or explosive materials, as well as moving vehicles with leaks causing leakage of hazardous substances, such as fuel, or dirt, as well as vehicles carrying hazardous materials, especially flammable, corrosive, explosive and others that pose a threat to life, health or property.

§ 9.

  1. Failure by the User to comply with the rules of use of the Parking Lot indicated in the Regulations will result in towing of the vehicle to a place in Warsaw selected by the Manager – with respect to applicable laws.
  2. Towing of the vehicle will be at the expense and risk of the User.
  3. The Manager shall also be entitled to remove, at the expense and risk of the User, any vehicle left in the Parking Lot after the expiration of the period for which the fee was paid.

§ 10.

  1. For matters unclear about the rules of use of the Parking Lot, please contact the Manager.
  2. Any comments regarding the operation of the Parking Lot should be reported to the Manager – at the Reception Desk of the Playroom or by e-mail: [email protected]
